ALL THAT REMAINS Guitarist Signed Will Week Before Death Naming Wife As Executor And Sole Benefactor

According to the Hartford Courant, a will signed by ALL THAT REMAINS guitarist Oliver "Oli" Herbert a week before his passing has been examined by police investigating his drowning death.

Oli signed a will on October 9 at at a Hartford, Connecticut car dealership. The will was notarized by a person who was a friend of the guitarist and his wife, Elizabeth Herbert, and who works at the dealership.

The Connecticut State Police Eastern District Crime Squad is investigating Herbert's death, which is being treated as suspicious. They are looking at the 11-page will as well as a life insurance policy mentioned in the will.

The will names Elizabeth Herbert as executor and sole benefactor. It says that Oliver Herber's sister, Cynthia Herbert, should not become executor or receive anything from his estate. The will also states that Elizabeth Herbert should get all "property as well as any current or future earnings."

One of the witnesses who signed the will, Alexander Mandel, also works at the dealership.

"I didn't even know who they were," Mandel told the Hartford Courant. "I was told, I think, he was a rock star or something.

Mandel said that Oliver Herbert was wearing a black T-shirt when he signed the will. "He didn't really say anything," Mandel said of Oliver.

Oli was found dead on October 16 at the edge of the pond on his Stafford Springs, Connecticut property. He was reported missing by his wife about 3 p.m., and his body was found by police face down at the edge of the pond where the water was only a few inches deep.

The guitarist and his wife purchased the home in 2013 for $135,000.

The Freedom Mortgage Corporation filed a foreclosure notice in June alleging that the musician hadn't paid the loan for the home. Herbert never contested the foreclosure and a judge issued a default motion against him for failing to appear in September, in effect granting the bank's foreclosure.

Last month, Freedom Mortgage Corporation asked a judge to grant a strict foreclosure on the property and allow it to immediately take possession of it.

Herbert began playing guitar at 14. He co-founded ALL THAT REMAINS with singer Phil Labonte in 1998.

ALL THAT REMAINS has released nine studio albums, a live CD/DVD, and has sold more than one million records worldwide.

The surviving members of ALL THAT REMAINSLabonte, Mike Martin (guitar),Jason Costa (drums) and Aaron Patrick (bass, backing vocals) — recently completed a European tour with SEVENDUST. Guitar virtuoso and YouTube personality Jason Richardson (ALL SHALL PERISH, CHELSEA GRIN, BORN OF OSIRIS) filled in on the trek.
