LAMB OF GOD Frontman Acquitted Of Manslaughter - Mar. 5, 2013
LAMB OF GOD frontman Randy Blythe was found not guilty of manslaughter earlier today (Tuesday, March 5) by a panel of Czech judges in the concert death of one of the metal band's fans.

Blythe was facing the possibility of conviction and a long-term jail sentence after a May 2010 incident in which a fan, Daniel Nosek, who attended a LAMB OF GOD performance in Prague, died almost a month later, allegedly from injuries sustained when he was thrown off the stage.

"I have been found not guilty and acquitted of all charges against me," Randy wrote on his Instagram account. "I am a free man.

"Please remember the family of Daniel Nosek in your thoughts and prayers in this difficult time. I only wish for them peace. Thank you for your support."

Tuesday's ruling by Prague's Municipal Court was confirmed by the court spokeswoman, Marketa Puci.

"We did not find criminal responsibility in the actions of the defendant," presiding judge Tomáš Kubovec said. "We found moral responsibility. There has been the death of a young man who had not been guilty of anything."

"The acquittal does not prevent the defendant, if he feels some moral responsibility, to enter negotiations with the family of the victim and act accordingly," the judge added.

The state prosecutors have announced their intention to appeal the verdict; they have eight days to put this in writing.

Randy's trial resumed yesterday (Monday, March 4) after court was adjourned last month due to missing witnesses (two expert witnesses – criminal psychologist/psychiatrist and a girl who attended the concert).

Kubovec said the opinions found in their reports were basically the same, according to WTVR.com. However, during testimony, they disagreed on how aggressive/anti-social Blythe is.

"I would like to thank the family of Daniel Nosek for not attacking me in the press and for their kind words to me in this court," Randy said in a statement to the court before the verdict was announced (see video below). "I am very sorry for their loss.

"Daniel was a fan of my band. I had no wish to harm him. He was just a boy and I wish he was still here.

"If, ultimately, the Czech legal system sentences me to prison, I will do my sentence like a man.

"If I am to remain free, I will do my best to insure that conditions at this concert will not occur again with my band and other bands so that the fans will remain safe.

"I have searched for an answer to this situation. The only one I can find is that it was a tragic, horrible accident."

Blythe was unaware of a warrant out for his arrest when he was detained last June after arriving at the Prague airport for a show with LAMB OF GOD. He spent five weeks in custody before being released on bail in August.

The parents of the alleged victim were demanding compensation of 10 million Czech Koruna (approximately $530,000).

NO to compensation, but a good gesture would be to pick up the burial cost' it's not as if a world touring band like Lamb of God couldn't afford something like that. Some will ask why? It's the right thing to do and for the fact the Daniel Nosek, was a Lamb of God fan who died at their concert.

I'm sorry that the kid died at the concert. No kid should ever have to go through an incident like that. But, in my heart of hearts, Randy did nothing wrong and should have not been blamed for it. The kid should have done better and should have used better judgment, but got killed due to his own actions. Randy did nothing wrong and today's verdict proves it.

The difference being this wasn't a "frivolous lawsuit." This was a criminal case in which the defendant faced significant jail time. Maybe you should do some research in an attempt to differentiate the two. You might not sound/look so ignorant.

This surprised me, and if any of you weren't surprised, you're kidding yourself. To not think countries such as the Czech Republic are current and fair is being naive. I think Randy was very lucky he was found not guilty. Considering most of Russia and the outlying counties still live in 1959 are just slightly fucked up and not aware that time keeps moving.

This event and loss of life was an accident. Murder or Manslaughter were not justified and really an over reach of the prosecutor. Justice was rendered in the Czech. No disrespect to the deceased. May he RIP.

Regarding the lead singer...WOW what a stand up guy. Taking the heat like a MAN for what easily could have been attributed to many people in and out of the band.

If only all human beings were this honorable.

Im not a major fan of LOG. I have a few discs. But im gonna get more to just show my support.

Seriously very impressive display of courage.

Well there you have it...not guilty. I think he handled this with class and respect towards the family even though they had $$$ signs in their eyes but who knows what they were told or how they may have been manipulated. It sucks that this kid died but as someone said above, his own actions contributed to his death.

The video that said it all is the one where the security guard drops him down head first and he's really really slow to get up. I think that blow did it and the fans that saw that even seemed to be freaked out at the shot he took.

Again the right decision and I'm not even a LOG fan...

awesome, Randy! In this instance at least, the justice system worked and an innocent man (who WAS punished, folks) is free and I'm confident he'll release yet another killer record. Randy is a very classy and decent man who handled himself, as well as the entire ordeal, very well. This news has made my day.

It was frivolous because he never would have done ANY jail time, it was about getting compensation for the parents. If he'd been found guilty he would have paid a suitable amount and walked.

That dog won't hunt. If this case was only for the money, it would've been settled long ago for an undisclosed amount. If he would've been found guilty, he would've done prison time, no doubt, so you're wrong-yet again. Like, I said this was not a civil suit or lawsuit and your ignorance of the difference between those and criminal case is painfully obvious. Once this case began the trial phase, Randy's freedom was on the line, make no mistake. Keep thumbing up your own comments.

What did you miss? If he would have been found guilty, he would have faced a minimum of 10 years prison. Randy owes that kid that video recorded Daniel on stage, because it refuted everything the victims friends claimed.

Didn't think you'd get a fair shake. It's still bittersweet though that the kid died. Should never have happened. It's miserable that both Randy and the kid's family have to live with this the rest of their lives. Hopefully this will set a precedent for behavior at shows - fans, stay off the stage!

(Reuters) - A Czech court on Tuesday acquitted the frontman of U.S. heavy metal band Lamb of God of manslaughter charges in the death of a fan at a concert in Prague three years ago.

The presiding judge ruled that Blythe's actions did not constitute a crime. No further explanation of the verdict was immediately available. Prosecutors immediately appealed against the acquittal to the Czech High Court.

Sounds like the state prosecutors are wanting to ride the publicity out to show how big their wangs are and take more of his money.

You attack a judicial system with no basis in fact and quite clearly think that this would never have come to trial in your country.

What I described were two examples of trials that would happen anywhere else in the world.

when a boy has died and a family is forever left with this void.

but hopefully Randy can move on.

and hopefully this puts to rest the comments that the Czech Republic is a a crooked 3rd-world nation.

justice has been served with a positive outcome for an American musician making extreme (by public standards; not the metal communty's) music that many find distasteful if not offensive and anti-social. so, you would think a crooked system would easily favour its own citizenry over such a foreign musician.

not the case, obviously here.

and respect to Randy for his statement, which i believe he made before the verdict was announced. i don't care for his music but he seems to be a man of compassion and integrity.

i hope the family finds some peace.

I was one of the naysayers who thought you were getting railroaded and it could get worse. It is great to hear I was wrong.

I've been following this story through Blabbermouth and totally respect the way he has handled this with class from day one. I don't know much about the band but I will give a listen to anything they do from now on.

This sort of thing could've happened to any metal fan at any era in time, we get exited at shows. We jump on stage, we jump off stages, we mosh. The kid was having a good time at the show, I guarantee it. What happened was an accident and there's no one to pin it on.

Now you're just being dumb in an attempt to save face on the back of miserably losing an argument. I'll play along-here's logical thinking spoonfed to you in the form of words that you can hopefully read:

A.) Randy Blythe is a U.S. (possibly the most hated nation in the world among other countries) citizen facing trial in a former Communist state.

B.) There was already considerable evidence such as the fact that this was an "extreme metal" concert with inefficient security and that the concert-goer tried multiple times to climb the stage-a place he had no business in being. Also there was many eye witnesses who claimed Randy had no direct contact with the concert-goer that would've resulted in his unfortunate death. These are things typically addressed by courts prior to erroneously charging them-then again this is a foreign court system which alludes to my first point and furthermore would contribute to uncertainty of his freedom or fairness of this trial.

C.) Randy made multiple payments to court system exceeding hundreds of thousands of all dollars in what appeared to be a court ordered shakedown-which could be percieved as "unfair," by those with the ability to think.

Let's say, hypothetically, you were falsely accused of a crime (we'll say raping livestock for the sake of argument) in a foriegn country (a dissolved Soviet State perhaps) with credible evidence and circumstances pointing to the fact that you did not commit the alleged crime. On top of that, you made a multitude of payments to the court system for "bail," and they still decided to try you. How confident would you be about the incoming verdict?

You referenced in a sarcastic tone "Don't tell me your naive enough to think that frivolous law suits don't come up all the time in other countries involving celebrities?"-Simply put, no they don't. Lastly, you did know you could thumb up your own ridiculous comment(s) because you've been doing it, so not only are you ignorant but you're a liar too. Sorry about your luck, Jack.

this thread is a great example why. I wonder how many people on here ever visited the czech republic. Randy knew why he went back, because he knows better than many jerks on here.

I am not Czech, but I got friends over there who enjoy way more freedoms than some friends of mine in the US, which I avoid anytime I climb a plane to cross the pond.

That's not because of the people in general - again, I have good friends over there, been there like 7,8 times and used to work for a guy from Austin.

However, this belief in superiority on every level and the idea that the US is the best place to live and enjoy maximum freedom, highest standard of living or education is W-R-O-N-G.

You're living in a big, big country, so I get why it is not necessary to learn any foreign languages or leave the country for whatever you'd like to do on your vacation.

But if I'd take half of the stuff I see on TV on American prisons, gangs, trailerpark trash and so on and GENERALIZE that, I would have no doubt that the US is a 3rd world nation full of scum to the rim.

If Danial Whatshisface hadn't climbed on stage at least 3 times like a complete fucking moron, Randy wouldn't have lost a big part of his life and a small FORTUNE in defense costs. I wouldn't be surprised if the prosecution DID appeal this particular case. Correct me if I'm wrong, but didn't something similar happen with the Nergal bible-ripping case? I know acquittals can't be appealed in the States, though I'm sure Fred Goldman and company certainly wish that wasn't the case. That aside, I'm happy that justice has prevailed, and Blythe remains a free man!
