METALLICA Versus METALLICA In Burnaby - Feb. 2, 2013
According to Burnaby Now, the Canadian Intellectual Property Office ruled last September that the Burnaby, British Columbia, Canada metal shop named Metallica Manufacturing is free to continue pursuing its trademark application for the word "Metallica" despite opposition from the metal band with the same name.

Metallica Manufacturing owner Bill Lawson tells Burnaby Now that name was chosen in the late 1990s by his then-12-year-old niece. After operating under the name for four or five years, Lawson tried to register a domain name online, which is when the group's attorneys started calling for the shop to change its name.

"I appreciate the music and what they do, but at the same time do they even know about them actually coming after us or is it their team of lawyers?" Lawson's 24-year-old son Dan asked. "The lawyers we are dealing with are Canadian lawyers, and those lawyers are based in Toronto, and it could be that the band knows very little about what's going on. Up until this last decision, this was a major decision, to let this tin-pot company win this verdict across the country. Now if that's the case, surely that news would have gone back to the band."

I remember Metallica attorneys making Revlon lipstick pull their Metallica colored lipstick from the market years ago. My guess is that Metallica will ultimately win this too once they throw more money at it. Gotta protect the brand in the market place I guess. How 'bout a genuine old school thrash album instead of all this crap?

It has no other meaning than the band. It's unique to them. Unlike, say Judas Priest or Iron Maiden, which were well know words before the bands. As much as it sucks, I completely understand why they'd want to protect the right to this name.

Whether true or not, look up Metallica in the dictionary. You'll find nothing - unless reference to the band. They used the name to success, he didn't (if your claim is true.) That would be the difference.

They didn't steal the name, they asked to use it - Ron Quintana (person who came up with the word "metallica") has said as much in interviews I've seen in thrash documentaries

...by the 90's (when this happened), Metallica were no longer some underground craze...nor were they "merely" an established act like Maiden or Priest.

They were a household name, right up there w/ Madonna and Bruce Springsteen! It's like me forming a company called "Michael Jackson Window Frames" and expecting to get away with it. Seriously?

Wow, you're so smart. In fact, his friend had multiple names and Lars encouraged him to use a different name for his fanzine so he could use Metallica. Just because he used a name his friend thought up - with his full knowledge - does not make it stealing. The band made the name what it is through years of hard work and it is their trademark. You fucking trivia buffs should try to get your facts straight!

Metallica manufacturing will probably be no different than Metallica the band. That is, produce 8 years of quality products, then start going down the tubes in quality control. Fast-forward 17 years later, they'll make a half-assed attempt at QC but in the end, miss the mark. Then you'll have the Metallica Manufacturing Family.

Did Ron Quintana ever sue Lars for the latter nicking his band's name from Ron's fanzine?

That's really, really fucking lame. This company is a family-owned business that creates manufacturing jobs locally instead of having it done in China like the bigger coprs do. And there you have Metallica's lawyers trying to put it down for the benefit of a bunch of washed-out millionaires. FUCKING SHAME.

Time was you had to either; prove loss or prove; the party was fraudulently construing an official affiliation to you, to get away suing people for this sort of thing.

How exactly is Metallica losing out; are they planning to start a brand of metalwork? Is this guy claiming that he's associated to Metallica, the band?

Glad to see I'm not the only one who remembers how Metallica got their name, which makes this kind of ironic. I get protecting your brand and all, but really, how the fuck does this business existing with this name-which its had for years-hurt Metallica? People going to stop going to their concerts and show up at this guy's business instead?

Stop being so fucking corporate, guys. I actually hope this guy gets the trademark.

The band has a right to keep it's name to itself. Just like I can't open up a shop called Budweiser Plumbing. These little guys are so uncreative that they can't come up with there own name. I hope that they go under, the little name stealing bastards. By the way, I am a metal fan not a Metallica fan. But I think taking someone elses trademakd name is wrong no matter what.

which is rare these days! but 'Metallica Manufacturing' sounds like it could be a band owned company, especially now that they have their own label. Something like the lipstick, that was a little silly, but this is just too much a case where someone can assume the band is connected to it. and really what did this guy think? that they wouldn't notice?

Thinking "names" like "Metallica" should be intellectual property, as if they're patents for some brilliant new engine design or something.

These guys aren't working in the music industry or anywhere vaguely nearabouts and there's no reason to think they're trying to trade off the back of Metallica's music whatsoever. Metallica stands to lose precisely zero dollars through their use of this name. Not to mention, the very idea that you can trademark a word in this fashion is deeply offensive to the English language, not that that's ever bothered American "HURR LETS SUE EVERYBAWDYY." philistines.

It's also wildly hypocritical, as Metallica were not the first to use the word "metallica" and certainly did not come up with it. It's a fucking derivative form of the common English word "metallic", in the same vein as "esoterica", meaning "an assortment of things which are metallic/esoteric". Only in the United States of Idiots could they be so illiterate as to allow someone to own an English word.

There's a dry cleaning shop near me in London called "Iron Maiden". Should they be sued, for potentially usurping IM's potential holdings in the fucking laundry industry? Ridiculous people, Americans and their lawyers. Metallica sucks arse, bunch of washed-up old fucks that haven't made a good album in over 20 years. Fuck Lars, the man that sued a child.

I was born and raised in Burnaby,and still live in Burnaby.I see the Metallica Mfg van a few blocks away,in an old school friends house!My work sells sheet metal to Metallica Mfg.First time I saw the name on a work order years ago,I laughed.Very small company,using the name,but thier logo is not the same Metallica font.They dont use any artwork or lettering from the band,just that name!Burnaby makes Blabbermouth!!

And Quaker Oats should sue the band for their Cap'ns of Krunch shirts and road crew laminates during the Damage Justice tour.

Regardless of whether Lars took the name or not, the band trademarked it worldwide, used it to make a living, and have become synonymous with the name. They have a legal obligation to defend that trademark.

Call Metallica douchebags all you like, but whether you like it (or them) or not, they're well within their rights here and will win this case. That manufacturing shop should have known better.

Especially if you try to snatch a name from the band notorious for their lawsuits.

One Metallica to rule them all. This guy is dumb for calling it that in the first place, after they became a household name no less. I used to know of a tattoo place called Metallica, I don't know if they are still around though. But could very well be.
