DEF LEPPARD Singer Slams Former Record Label Over Digital Rights To Back Catalog - Jan. 10, 2013
DEF LEPPARD last year joined the long list of rockers who have re-recorded their biggest hits in note-perfect renditions. The "2012" versions of "Pour Some Sugar On Me" and "Rock Of Ages" are now available at various digital retailers and last month the band cut five acoustic songs performed during their "Rock Of Ages" tour for a medley released to iTunes.

DEF LEPPARD frontman Joe Elliott tells Classic Rock magazine: "We're trying to wrestle back our career and ownership of these songs. They [Universal] own the originals; we're at loggerheads with them over the digital rights. And as long as they're playing silly buggers, we'll just keep recording them again."

The singer continued: "Until we can come to some kind of humane conclusion to this ridiculous stand-off, we're going to say, 'Fuck you!' We were offered a great deal two years ago and shook hands on it. And then some other twat at the label put a stop to it. It's our life and our music and we're not going to let them exploit us to the extent that they're trying to."

Elliott tells Classic Rock that Universal wouldn't be the major player it is today without the help of LEPPARD's multi-million-selling releases.

"Between us and BON JOVI, we fucking built that company," he insisted. "We built their penthouse sushi bar, wherever it may be, and they just treated us like shit. We can either roll over like little dandelions or we can stand up and punch them in the bollocks. And that's exactly what we're doing."

Elliott previously told The Hollywood Reporter that DEF LEPPARD is in a unique position because they are one of few bands to have veto power. He said, "[Universal] can't release our back catalog, we're not going to let them put a song on a compilation unless we want it there, and they'll never be able to license. They won't be able to do anything without our permission because that's in our contract."

Asked to explain the crux of the band's argument, Elliott said, "We want to get the same rate for digital as we do when we sell CDs, and they're trying to give us a rate that doesn't even come close. They illegally put up our songs for a while, paying us the rate they chose without even negotiating with us, so we had our lawyer take them down.

He added, "When you do your own recordings, you're making about 85 percent and 15 percent goes to iTunes or whichever particular digital domain you put them up. Something along those lines would be fair. But they were offering us the opposite — a quarter of what we get paid on our CDs. So we thought if we can't get them to pay us a decent rate on the digital, then we're going to go in, re-record them and pay ourselves decently. Because we're not fighting against our own back catalog. If we put rerecords up against the originals, nobody would buy the re-records. So what we're trying to create is what they know by making as close as we can, forgeries of what we did in '83, '81, '87…"

Your high priced lawyers checked over the contract and then you signed it. You also have a penthouse sushi bar. Tough shit.

you still made great music like those 80's classics you would not have to worry about royalties for the old stuff. ondefeated was start so make a record like that and you might sell some cd's again.

Mr Elliot, you owe everything to Universal. They're the ones who marketed your abandoning anything vaguely credible in favour of anodyne, antiseptic, anonymous pop PAP as rock n' roll. A drum machine on 'Pyromania' because a real drummer would get in the way?

You should be on your knees praying to Universal and thanking them that such an average singer and no personality frontman was ever able to eke out any kind of career.

I loathe Def Leppard and all they represent. I'm seized by an irrational incandescence whenever I pause to calculate how successful they've been. They're an abomination.

You know, I dislike the pop rock style of music that they've been playing for the past 20 years as well but as much as I dislike it, it clearly sold a ton so they deserve their credit IMO. Its the crap like Justin Bieber and One Direction that I just can't understand.

As big as Bon Jovi and Def Leppard were in the day I find it a stretch to say those two bands built Universal. As a part of Polygram, Universal has been solid since the early 1920s as a music label.

Universal helped make Def Leppard a household name when Hysteria came out. The band couldn't have done two years of sold out tours and all of those videos on their own. They need to give credit where credit is due. And, for the record, I'm not a hater. I just didn't listen to them beyond Hysteria because the music wasn't that great.

Def Leppard need to face the fact that they aren't that relevant anymore. Get over it and be happy that you're making any money at all.

I think the point is that they want to get paid a fair share for the work they've done. If you made a ton of money for your employer and they wanted to bust you down to minimum wage you'd be pissed off, too. To take Joe's point one step further, clearly they don't sell as many records as they once did, so it makes sense to try to get the most out of what they do sell.

Read the article and stop making ignorant comments.

There is no contract for digital rights. The bands lawyer was really smart and at the time could see where the technology was going. He knew not to lock them into something they would regret later.

Universal didn't create the music, they didn't promote it, they didn't tour it. They were a bank, they loaned the band the money to record and tour and were paid back with interest. Now they got greedy because they signed a bad contract with def leppard and want more. Def Leppard are standing up for themselves and are saying all we want is what's fair.

Between illegal downloading and record companies trying to rip the artists off the bands have little chance at turning any profit these days. Just because the huge band like def leppard are fighting the "man" doesn't mean they are being greedy or don't deserve to be compensated for what they created. The band has lost millions by not having their back catalog on itunes. All for standing up for what they believe.

They should be praised not bashed for it.

I'll leave you with this. If you went to work and one day you were paid $25 an hour. Then the next day you went to work doing the same Job and they tried to pay you $5 an hour. Would you be pissed off would you defend yourself?

Exactly

and cue the thumbs down from the low IQ High RPM readers that can't quite grasp any of this.

But years before you lost the $25 an hour, someone told you about MP3's and you were so high on your plastic CD's, you ignored them. MP3's was offered to all record companies, they are just like accountants, without talented people in the world to help, useless.

Yes, the record company is trying to screw them. I get that. But these re-recordings are far from "note perfect". They do NOT sound the same. So they are just screwing their fans by releasing new recordings digitally instead of the originals. I want the band to get paid for their hard work. But not if the fans get stuck with these fake ass re-recordings in the process!

It was OK when Testament did it. The songs on FSSD sound superior to the originals. This was done for a different reason, though. The band wanted to remaster the first 3 albums and Atlantic (who owns the masters) wasn't interested.

These turds need to flush each other at the halfway point.

"If we do it ourselves we get 85 percent, so that's what we should get."

Um, you didn't do it yourself, you did it with the help of Universal.

Seen Def Leppard few years ago and 3/4 of the set was cover songs they must've had a album with covers on it. Real disappointed at the show, the only high/low point of the show was some 50 something crusty drunken lady was stripping most of the show, she finally got tossed when she tried to remove her pants.

Gotta luv Cougar Rock...

How are they screwing their fans by offering new recordings when nothing else is available digitally? Nobody is forcing the fans to buy the rerecords. The fans know they are rerecords. Nobody expects music that was recorded 25 to 35 years and then rerecorded today to sound the same. It's ridiculous to even expect that.

It's just an option. if the fans want the real recordings they can order the hard copy CD's and have them delivered to their home. They just cant download them.

It's that simple

You are either incredibly stupid or you're a straight up fucking liar. They have gone WAY out of their way to describe the re-recordings as sounding identical to the originals. And the fans are getting screwed exactly for the reason that the originals aren't available so they're trying to pass these of instead. It's call "bait and switch" asshole. Not all Def Leppard's fans are so obsessed with them that they have one of their songs as a screen name on the internet. I'm guessing many of their casual fans might want to buy their biggests hits to hear the songs they remember, only to get these incredibly lame ass re-recordings. That's called a RIP OFF!

Again, if you can't see that their fans are getting screwed by them butchering their own songs over 20 years later and passing them off as "note perfect" to their casual fans, you are either an idiot or a liar. I'm guessing the latter!

Hemiskull the covers album Tour had 4 songs at the most per night. Pretty normal for any new album in a 18 to 20 song set list.

Why is this even a big deal?

If you're a Def Leppard fan, you most likely already own the old CD's or at least the Greatest Hits CD that came out a few years ago. If you don't own the old CD's you could easily buy any of them from Amazon.com and if you buy the used CD's you could get some for less than $5.

People act like if you can't download music through iTunes, then the music is unavailable to you. That's the biggest crock of shit!

As far as the rerecordings. What's the big deal? They're advertising them as rerecordings! They're not ripping off anyone. If you don't want them don't buy them, just buy the Greatest Hits CD through Amazon.com.

Why are so many people so stupid and lazy?

the record company couldnt take the song down--cuz they altered the tape speed just a little
---
this might help you get your tracks back----just alter the speed--just barely--where the human ear cant notice

but its "not the same track" and you might get it back

maybe

I agree with you 110%.

Most artist are getting their back catalogs back. I was just told Bryan Adams received his entire back catalog masters as well as the Eagles because there is some sort of law that gives the artist some sort of freedom to pick of the option of owning the masters. The unfortunate thing is that are they going to Reissue these on vinyl or whatever? Most don't know what to do with them with the acception of Clutch or Motley. Even though Nikki fucked everyone not releasing the 2nd Corabi album personality #9.

How is Slang going to be issued on vinyl?

Whatever they're saying, anyone can download their biggest hits from some site without paying anything and conclude that the band made couple of nice hits and that was it.

Besides, Polygram was very fair as they pumped a shit load of money into Hysteria and Pyromania without any guarantees of albums selling anything.
