BEHEMOTH Frontman Faces Second Trial In Bible-Tearing Case - Jan. 8, 2013
According to Polskie Radio, BEHEMOTH frontman Adam "Nergal" Darski faces a second trial in Poland on charges he insulted religious sentiment when he called the Catholic Church "the most murderous cult on the planet" during the band's September 2007 performance in Gdynia and tore up a copy of the Bible, calling it "a book of lies."

A district court in Gdansk Tuesday overruled an earlier judgment that Darski was expressing artistic freedom during the concert.

The European Commission last fall said that Poland's prosecution of Darski for "blasphemy" is against European values.

In a statement released last October, it said that "national blasphemy laws are a matter for the domestic legal order of the member states."

It cited the European Convention Of Human Rights, a Poland-signatory treaty attached to the Strasbourg-based rights watchdog, the Council of Europe, on freedom of expression.

"This right protects not only information or ideas that are favorably received or regarded as inoffensive or as a matter of indifference, but also those that offend, shock or disturb," the commission said.

Back in August 2011, a Polish judge ruled that Darski's ripping up of a Bible during a show was a form of artistic expression consistent with the style of his band.

Judge Krzysztof Wieckowski said he considered Darski's actions "a form of art." He added that the court had no intention of limiting freedom of expression or the right to criticize religion.

The court said audience members who testified said their religious feelings had not been hurt despite the fact they were Christians.

The crime carries a maximum sentence of two years in jail.

After the 2007 incident, Ryszard Nowak, chairman of the privately run Nationwide Defence Committee Against Sects, sued BEHEMOTH for promoting Satanism. Although a court expert witness on religious matters said that the act of destroying the Holy Bible could offend somebody's religious feelings, the case was discontinued because no one except Nowak accused BEHEMOTH of insulting their religious beliefs. (Under Polish law, there must be at least two formal complaints before a charge is laid. The previous complaint was made in 2008, and an unspecified number of other complaints had subsequently been filed.)

In a 2009 interview with Decibel magazine, BEHEMOTH bassist Tomasz "Orion" Wróblewski explained that the Bible-tearing incident was by no means a spontaneous outburst. "We'd been doing that for two years on tour before it happened in Poland," he said. "So, we had discussed it many times before. A BEHEMOTH show is a BEHEMOTH show, and BEHEMOTH fans are coming to a BEHEMOTH show. BEHEMOTH fans know what BEHEMOTH is about, know what the lyrics are about, and know at least a little of the philosophy behind the band. So, it's kind of surprising that there are people coming to the shows and feeling offended with what we do onstage. If such a person comes to a show, he comes with the purpose of being offended, I guess, and it shouldn't be like that. We're not offending any particular person. We're just offending the religion that we've been raised in."

He's right about the Catholic Church bit. That's a historical fact. As for ripping up a Bible, didn't the Nazis burn all sorts of books when they invaded Poland. You think those religious zealots would have learned something about tolerance. But not Catholics I guess. They're as close-minded as ever. Bomb the Vatican and hang the Pope.They're part of the NWO.

have terrorised Europe and the world for nearly 2000 years. They are murderers, deceivers and child rapists. They are fascists who brook no criticism of their gaudy gold-drenched cult and sidle up to dictators. The Catholics will spend millions and invest massive energy trying to stop gay marriage from becoming legal in the UK... but barely even tried to resist Mussolini and Hitler. Where people are just enough to stand against their lies, they cry "persecution" and make out that they are the victim. They are a dangerous Dark Age cult that needs to be consigned to ignominy as they deserve.

I'm a Christian. And by that I mean I believe in the existence of God. I fucking hate organised religion though. I wouldn't be offended if I went to a Behemoth show and saw this. I like Behemoth, I know what I'm going to see. Anyone who was at that show who was 'shocked' shouldn't be there in the first place.

How burning a Bible is considered a crime is beyond me. It's a book at the end of the day. A bit of leather with paper inside. If someone burns my laptop with a copy of the Bible on it, are they also burning the Bible or are they just burning a laptop? It makes no sense.

The Bible is a book, with a lot of meaning behind it and all that. But at the end of the day, in essence, he could have been burning 50 Shades of Grey and it would be no different. He's not burning every Bible available, it's not like he's burning any audience members personal belongings, or taking away someone's right to go read the Bible or anything. He could have burnt any book.

He's making a statement on his beliefs, and I respect that. If he believes in Satan, he obviously believes in God, so therefor he's just stating how he feels about God. It's his right to have his own opinion and he's not hurting anyone.

As I said, I'm a Christian but everyone is entitled to their own opinion.

Don't qoute me on this, but I do believe that nergal believes there are "gods". Obviously he has his opinioin about the catholics and that's fine. But as for you being a christian, he would still spit in your face. They have a song with the title "Christians to the lions". And I'm not saying any of this negatively. I'm a Christian myself and I believe that even though they are an awesome band, they still look down on you and I because of our beliefs ( as do much of the other blabbermouth trolls and the rest of this pathetic world). That's fine with me though, we will all see in the end.

Mind boggling how this has even made it to a court case. Talk about a waste of everyone's time and energy.

Get with the times Poland. Anyone with half a brain knows that religion in this day and age cannot be taken seriously.

Ofcourse its a book of lies and fairytales, science has just about completely destroyed it.

I do find it amusing when metal bands bad mouth religion and God, saying thats it all bullshit, but they will still praise Satan though lol.

Just remember kids: Religion was created by men, and usually men have a lot of perjudice, so, it's far from being perfect. Thru history, we have seen priests commiting rape, abuse of power and everything in between. Then those free of sin, throw the first stone.
