CENTURY MEDIA Vs. LACUNA COIL Illegal Downloaders: Nearly A Thousand Subpoenas Quashed By Judge - Oct. 17, 2012
A New Jersey judge has quashed nearly a thousand of subpoenas that were requested in a BitTorrent suit involving "Dark Adrenaline", the most recent album by the Italian band LACUNA COIL, ruling that the case improperly joins mass defendants together.

U.S. District Judge Faith S. Hochberg threw out all of the defendants with the exception of one John Doe for the claim. As a result, 943 unnamed defendants have been pared from suit filed by a New Jersey attorney on behalf of Century Media Records.

Hochberg, in her October 10 ruling, said that the case appeared to be a misjoinder, finding that "there must be a connection between defendants beyond the copyrighted work and method of distribution, namely that defendants were involved in the same transaction with the same downloader at the same time."

In the case, Hochberg said that she would sever all Doe defendants except the first Doe of the suit "without prejudice," permitting the plaintiff to bring the claim again in conformity with the rules set forth by the judge.

In a typical illegal-downloading case, a lawyer hires a company to search for Internet protocol (IP) addresses associated with the use of file-sharing software such as BitTorrent. Once the IP addresses have been harvested, the lawyer's clients file suit naming defendants as John Doe. They then seek to have mass subpoenas issued for the Internet providers associated with the harvested IP addresses in order to obtain the name and address of the owner of the IP address on the date it was harvested. Once identified, an Internet account holder typically faces the prospect of settling the case for a few thousand dollars or hiring a lawyer to fight the charges.

"It's tough. If you get one of these letters you've been put in a difficult and unfair spot," said Rebecca Jeschke, a spokeswoman for the Electronic Frontier Foundation, a San Francisco-based civil-liberties group, referring to the notices that go out once a John Doe has been identified.

"In many of these situations," she added, "the goal doesn't seem to be to fight infringement; it seems to be to get settlements. That's where the money-making is."

Nuclear Blast Records made headlines earlier in the year when it filed a lawsuit against 80 users of the BitTorrent network over illegal music downloads of an album by Oakland, California-based extreme metallers ALL SHALL PERISH. The lawsuit was not only brought without the band's permission, but also without their knowledge.

After members of ALL SHALL PERISH made it clear that they did not want to participate in the legal proceedings, Nuclear Blast voluntarily dismissed the lawsuit without prejudice.

In December 2008, the Recording Industry Association Of America (RIAA) abandoned its litigation campaign against file sharers after having targeted some 18,000 individuals, usually naming dozens or hundreds of defendants per suit.

Most of the defendants settled out of court for a few thousand dollars rather than risk Copyright Act fines of up to $150,000 per purloined music track.

John Doe was a great serie, very captivating, too bad it was cancelled after its first season. It came out like 10 years ago or so on Fox.

John Doe was played by Dominic Purcell, the guy who also played Lincoln Burrows on Prison Break.

True in principle, but because these are IP addresses, if you're unfortunate enough to have someone living or visiting your home downloading stuff off of Bittorrent, you would get one of these letters.

While illegal downloading is clearly wrong and hurting the music industry, the means by which these lawyers are going after people for quick settlements is wrong also. I would venture there are much more noble causes than filing class action suits against people who probably have little disposable income to begin with.

Things seem to be working out rather well in Century Media land... what a surprise... I guess blindly suing a bunch of numbers doesn't always fly with the man behind the bench.

Why would anyone want to invest, sign or buy from Century Media? I just visited their site and honestly, there isn't one band on that label I can't do without.

Century Media is just trying to stay alive. If they go down, the bands on their label go down as well. Remember, if you illegally download albums, you hurt the record label and the bands. It doesn't matter if you decide to buy the album later. The damage is already done because 9 times out of 10, when someone illegally downloads an album and they like it, chances are they aren't going to buy it. This shit isn't going to stop unless the judge puts a harsh sentence on these basement dwelling criminals. Maybe then, people would think twice about ripping off bands music for free. Metalheads are killing metal.

Boohoo. Broken business models are what's killing the entire music industry, not just mettle. Downloading has been going on for 10 years now and has become the norm over CDs/LPs. If labels figured that out before sales came stockpiling down, maybe their losses would have been less severe. And it's not entirely unimaginable that music as we know it will not last, in terms of money involved. It's a buyers' market, and people aren't buying. Take a look at any 80s Fortune 500. A lot of those companies don't even exist anymore.

.. They said that about taping stuff 20-30 years ago. Did the fatcat record companies go bust then?? NO!!
Problem is the market is flooded with so many more bands now fans cant afford to buy every cd that comes out. I download stuff then buy the ones I like as often as possible.
Also im not going to buy a cd I dont like, even if it by a band im really into... Bought a few 'lemons' by my favorite bands over the years and got fed up with it...

Before I go into detail, I'll say that I think music prices are low enough now ($7.99 - $9.99) for most cd's that people have no real excuse not to purchase. If you can afford high speed internet and a computer capable of downloading and burning this music, then you can spare 8 bucks. That being said, these lawsuits are crap and CM made a big mistake. There are so many ways that someone could be unfairly targeted because their IP showed up on a list. Stolen wifi, a parent with a kid that decided to try it in his bedroom without them knowing...etc. There's no warning shot with this kind of thing, they just sue you or pressure you into settling through scare tactics.

The soon to be implemented "strike" policy's that ISP's have agreed to will help to give fair warning to people. The ISP will notify you that an illegal download has taken place under your IP address and stress the consequences. After you receive a "strike", anyone who is truly unaware of what was going on will do something about it. After so many strikes, if you're taken to court then that's on you. I think that's a fair deal. CM disregarded Iced Earth's comments about how they were against the suit, and now it looks like they're all going to be thrown out anyway. Technically, they could sue everyone individually, but with a court filing fee of $350 per person, that's a lot of money to put out on a case that could easily be dismissed.
