NUCLEAR BLAST Calls Off 'File-Sharing' Lawsuit Over ALL SHALL PERISH Album - July 20, 2012
Nuclear Blast Records has issued the following statement regarding the label's recent lawsuit with the BitTorrent network over illegal music downloads of an album by Oakland, California-based extreme metallers ALL SHALL PERISH:

"Nuclear Blast and SKP Enforcement UG, who are experienced in tracking illegal downloads and the file sharing of music, recently decided to cooperate with World Digital Rights to fight against file-sharing piracy in the USA. In the United States, the providers are obligated by law to hand out the IP addresses of the computers from which the downloads / file shares were generated. By collecting this information, these companies are also acting in the interest of our artists, which is essential to the future of both our bands and the label.

"To be able to recoup the investments both parties have made is crucial in order to produce new music and to survive in this business. Nuclear Blast, SKP Enforcement, and World Digital Rights want people to be aware that the peer-to-peer file sharing is illegal and hurts the bands and record companies they love.

"That said, Nuclear Blast also respects bands such as ALL SHALL PERISH that do not wish to pursue file sharers. ALL SHALL PERISH was not consulted about this course of action and did not wish to participate in it whatsoever. When they learned about it, they immediately asked us to cease all legal action against their fans, file traders or otherwise, as soon as they learned this action had been taken in their name. Therefore, Nuclear Blast and World Digital Rights decided recently to stop legal actions against the file sharing with songs from the band ALL SHALL PERISH.

"In all other cases, the parties involved pursue those violating copyright laws to avoid the financial loss they incur and to protect the value of their copyrights.

"Nuclear Blast counts on the loyal fans which have been supporting the label and our bands for over 20 years now. Every sale helps support metal and the people that work hard to bring metal to the masses. For those that continue to buy music legally, that is something every loyal fan can be proud of."

According to TorrentFreak.com, the above-mentioned lawsuit was brought on behalf of Nuclear Blast against individuals alleged to have downloaded ALL SHALL PERISH's latest album, "This Is Where It Ends". The lawsuit was not only brought without the band's permission, but also without their knowledge.

"The band wasn't consulted whatsoever and none of us have ever heard of this company," ALL SHALL PERISH manager Ryan Downey told TorrentFreak.com.

ALL SHALL PERISH's fourth full-length album, "This Is Where It Ends" sold around 8,400 copies in the United States in its first week of release to debut at position No. 50 on The Billboard 200 chart. The band's previous CD, "Awaken The Dreamers", opened with 5,000 copies back in 2008 to land at No. 126.

"This Is Where It Ends" was released in July 2011.

In December 2008, the Recording Industry Association Of America (RIAA) abandoned its litigation campaign against file sharers after having targeted some 18,000 individuals, usually naming dozens or hundreds of defendants per suit.

Most of the defendants settled out of court for a few thousand dollars rather than risk Copyright Act fines of up to $150,000 per purloined music track.

Maybe labels\bands should begin to release a good quality product instead of compressed as f*uck garbage, which sound worse than mp3...
Why people should waste their money for CDs that sounds like a low-bit MP3?? they can just download it from any digital mp3 store - eventually they will get the same quality shit.
So, don't bitching about poor sales, idiots.

Just to give you some information. File sharing is how your bands get their name out. No one wastes their money on CD's that have a 8 in 10 chance of sucking. Thats how bands fill concerts. If you kill the sharing you will kill the concerts, thus killing the band. Times change and you must change with them. We always copied cassetts and CDs and we will long into the future.

I will never listen this band now.

this album is actually really fucking good. good songs, not as tech as some of their older stuff (like awaken the dreamers which old kirk hammett placed in his albums of the decade haha wtf) but yes this album has some good structure to the songs. oh and 'DM darkness' is still a knob boy :)

to combat downloading in the early 00's? They basically sent out promos to journalists with incomplete songs. That's right, the tracks would fade out roughly halfway through. Great promotional strategy that was! lol

I am all for NBA one of the biggest metal labels around who have some of the worlds greatest band around. people who steal suck. I wil not steal, and have never stolen, I support metal. I support the labels. The bands etc. You should to and those who steal I hope the RIAA fries your ass

I was sweating over this so I actually went out to buy it and figured it would help the second dude in the picture with a Martha Stewart hairdo have enough money to go get his roots done next month. Seriously though these guys fucking rock and their newest album is almost as good as their last. Their slow/progressive stuff makes me feel like I took 20 downers after I smoked a QP and then shot heroin.

Unfortunately, not enough people are smart enough and have enough foresight to see the other side of the picture when it comes to the issues of downloading.

You admonish others about 'stealing', but would gladly support the RIAA, the same bunch of assholes and lawyers in suits who will put the crooks, swindlers, con artists, and music business leeches who fleeced artists and bands for -decades- right back in their power again.

Got to love arbitrary moralism and the braindead who cling onto it desperately like a lifejacket.

how is downloading theft? if i went in your house and stole your tv for crack i would have deprived you of your property. But if you put a cd up for download i didn't steal your cd you gave me a COPY of it so you were not deprived of property.

everyone agrees EVERY METAL BAND has ripped off black sabbath so do you think black sabbath should have been able to sue new bands and stop them from innovating the genera?

Do you think its right for Monsanto to sue farmers for using their "intellectual property?" even when the farmer didn't steal or even intentionally use Monsanto's patented genes? If your farm is next to a farm that uses Monsanto crops and the wind pollinates your crops with pollen from theirs, next year when you plant your seeds you can be sued by Monsanto for millions for intellectual property even though you have no way of protecting your crops from pollen and have no way of knowing what pollen is patented and what is not.

This isn't theft and is a very complicated issue that has more to it than just downloading music. What happens when they start patenting human genes?
