RANDY BLYTHE's Bail Doubled; Prosecutor's Complaint Against Release Dismissed - July 17, 2012
According to the Czech news site iDNES.cz, a Prague Municipal Court dismissed on Monday (July 16) the Prague State Attorney's Office complaint against LAMB OF GOD singer Randy Blythe's release on bail. However, the court increased Blythe's bail from $200,000 — which has already been paid — to $400,000, which is said to be equivalent to twice Randy's annual income.

The Prague Monitor previously reported that district court judge Petr Fassati said that even after the latest ruling, a Prague attorney could still be allowed to again comment on bail.

Blythe was arrested in the Czech Republic on June 27 and is facing manslaughter charges in connection with a 2010 Prague concert at which he allegedly shoved a local fan off the stage. The man, who is said to have stormed the stage three times during the show, reportedly suffered a brain hemorrhage that resulted in his death nearly a month later.

Martin Holub, a lawyer at Šafra & Partners, told The Prague Post if bail is revoked, Blythe could be kept in prison for up to six months.

"The authorities will be concerned about him leaving the country and then having to begin extradition proceedings," Holub said. "If, however, the appeal court confirms the decision of the previous court, Randy Blythe should be released on the day that decision is made."

Jonathan Crane, a reporter from the Prague Post, told WTVR-TV that a legal expert believes the Blythe's defense team should have quite a strong case. "Even if Randy was responsible for the alleged attack, the expert said that who is to say that he wasn't accidentally kicked or trodden on or left without help by fans below the stage," Crane said.

The U.S. Embassy in Prague on last week released a very brief statement regarding Blythe: "The U.S. Embassy provides standard consular services to American citizens in need of assistance. We cannot discuss specific cases due to privacy concerns."

It has been previously reported that even if the Prague Municipal Court agrees to let the bail stand, the prosecutor can still "comment" on the bail - meaning he can tie this process up further keeping Randy behind bars.

I won't be surprised if Randy is left in a legal hell storm for awhile yet.

How many bands stopped touring the U.S after Dimebag was shot in the head, by an American exercising his constitutional "right to bear arms" ?

At least Randy is still breathing & has the opportunity to defend himself even if the "justice" system may seem a bit questionable. And should he face trial & be acquitted he will get his money back.

Anyway doesn't the American legal system allow "rock stars" to buy their way out of jail ? Vince Neil comes to mind.......

This is fucking ridiculous, what about the crazed fan who jumped on stage and fucking shot Dimebag? With this big of a band you don't know who is at the show and why, also it's kind of common sense that if you jump on a stage while a band as popular as LOG is playing you should expect to be thrown off by security, and why than aren't they suing all the fans who didn't catch this ballsack also, and the venue for not stopping the kid from getting on the stage in the first place...... I don't even like Lamb of God this is just the biggest bullshit I've heard of in quite some time.

that his bail money will be returned after court proceedings are completed? or in this country, does the court keep it?

if it is returned, then it doesnt make sense that its a shakedown.(at least this aspect of it) seems like the court wanted to find another way to keep him longer without looking bad by supporting the prosecutors challenge..

hopefully the prosecutor will not challenge again and he will be released, but I wouldnt bet on that happening.

Of course it will be returned. That is the principle of bail. You give money to the state and they will let you wait for your trial outside a jail. If you don't show up to the trial, go dark or flee, you will never see your money again. Bail is set high so he won't flee to his home country. He would have no incentive to stay if they would keep his money anyway. People, who call this a "shake down" are clueless idiots. This is not a civil case. This is a criminal case.

Well, metal bands - especially American but I'd think all metal and hard rock bands should 100% boycott playing Prague until this is resolved. Yeah, sucks for the fans but the reality is this - they are making money from bands who go their on tour and this is now an obvious shakedown attempt. Stop it, hit them in the pocket book - venues won't be rented, hotels won't be used, taxes won't be paid, food won't be bought and consumed, municipalities will lose income for permits, promoters won't make money - there is a trickle down affect.

I dont know how Bail works in every country. Thats why it was an assumption. I wouldnt have thought that once he paid his bail, it could be challenged and then doubled either.

if they wanted to keep him from the outset, they could have denied bail, or made it 1 million or more.

If you really think it through. That's the only way that bail can work. The person, who paid bail, will get it back, eventually. Yes, they could have denied bail from the get go. Be glad that they didn't. And yes, the amount of bail can, has been and will also be challenged in the US by US prosecutors. That is not a foreign thing.

Of course this a shakedown - do you know how the legal and bail system works in Prague? Didn't think so. Nor do I or anybody else commenting on this story - and apparently American Embassy and Randy's lawyers are not understanding it either, they are making up the rules as they go. Very emblematic of these are old school corrupt governments, many still with Stalinesque attitude toward the legal system, foreigners and outsiders. There is little wiggle room - you go to jail and stay there for a long time regardless of evidence. In many of these countries, they are guilty until proven innocent. And you all think the American legal system is bad - old Soviet block countries are not as modern as the rest of the world believes. Ever watch Locked Up Abroad - global justice is just horrendous and that includes much of Europe as well.

I think it's obvious now that the Czech government is guilty of extortion because they have no reason for the increase of Randy's bail. He has been coorperative and is not a flight risk. This is imprisonment and extortion of a US citizen without conclusive evidence that he committed the crime. I am very disappointed that our goverment has not gotten involved in some way.

Everyone knows that the US judiciary has more in common with Middle East countries than it does with progressive, modern European countries such as Britain or Sweden. The victim definitely came into contact with tons of people at the show. We know he staged dived (dove?) multiple times and probably was moshing as well. This case is two years old: that means eye witness testimony is basically worthless, physical evidence is essentially non existent and medical evidence is too vague to really prove much in the way of who did what. I would think that the prosecution has a huge burden on them to really prove that something Randy did was a deciding factor in whether or not this poor fan lived or died.

The whole incident is very sad, but unless they have some *really* good evidence that we don't know about, I don't think Randy can really be held responsible.

Randy, his band members, crew, etc. have had their income stopped dead. Not to mention the legal bills randy now has, the expenses of his wife travelling and living in Prague etc.

bail can be increased after it has been paid the first time. This just happened with George Zimmerman, some of you must never keep up with the news.


Obviously, it was a tradeoff because the prosecutor's request to keep him locked up was denied. Unless they come up with a more convincing argument that he will flee, he should be released at the next hearing.

If you had been keeping up with the news, you would know that Zimmerman's bail was REVOKED after it was determined he was conspiring with his wife to hide $200,000 donated directly to him after the story exploded. It was then reissued at a million dollars, only after some haranguing about whether he was a flight risk or not.

The injury that led to the fan dying could have been caused at any point during that evening, quite possibly outwith the venue itself (even on another night altogether). Although, looking at the footage of the gig in question, if there was ANY time the kid was most likely to have got injured it looked like the side stage incident with the bouncer that did it, as the kid landed head first on the fucking concrete, took ages to get up again, and looked dazed & confused when he finally did get up. The crowd caught the guy when he leapt / got thrown off the stage anyway.

This is a total witch hunt... the prosecution are desperately trying to pin this on Randy when he's done fuck all wrong. Randy is being unfairly used as a scapegoat and it's a total fucking injustice.

At the end of the day, the only people who should be up on stage should be the musicians. I've known friends who have seriously injured themselves from acting like a primate and leaping from the stage. If you're retarded enough to do that shit in the first place, severe injury (possible fatality) is the risk you take.

There are plenty of ingnorant posts on here proclaiming the We should bomb the Czech republic, blah, blah, blah. Can a metalhead be a redneck? I guess so. People like 11:11 and wanteddead are examples of why, with the help of 8 years of Geroge Bush, Americans are reviled in much of the world. We are arrogant, thonmk we are better than the rest of the world.Loudly proclaim most other countries to be backward and living in the dark ages. We rock our attitude of forcing our beliefs down your throat at the barrel of a gun.Chanting U-S-A! U-S-A! Its no wonder other countries hate Americans. Their laws are not the same as ours. We see Randy getting railroaded, and I think its just that. The guy charged the stage not once, but 3 times.I am a singer in a metal band myself, and If you get up on my stage, essentially you are tresspassing.And I'm gonna push you off. I can sing the songs just fine, I don't need help. Randy pushed him off the stage as most performers probably would have. It's tragic, but not andy Blythe's fault.

At your biggest gig, that stage was still owned by the community center... just because you're on it, it doesn't make it yours.

I would hope the prosecution has some level of proof outside of the video which shows absolutely nothing. Not knowing the standard of proof in this republic randy could find himself in real trouble. If the standards are low he could end up in jail till he is 51.

With the bail, I don't think it is a shake down just that it is nonsenseical how this is being handled. Bail set at $200k then prosecution fights it and randy sits for 2weeks then $400k but prosecution can still challenge. So explain to me how this makes sense.

And I agree that no metal acts should play anywhere near this. Unless the stage is behing thick bullet proof glass you will be held accountable for any morons injury who prances on stage. The liability is far to great

Yes, they increased the bail but the key part of this article is that the court dismissed the complaint over Randy being released on bail at all. They increased the bail to make sure he will come back for trial. I highly doubt they are going to reset the bail and then seriously consider the State Attorney's complaint again. If Randy's team comes up with the new bail amount, I suspect it will be approved and Randy will be released Thursday or Friday (unless they are also Czech holidays).

If I was in a band touring, I would have second thoughts about going to the Czech Republic. Defend the CR all you want but if they really didn't mention this incident or try to extradite Randy for two years, and just waited for him to re-enter the country, that is lame to an epic degree. If you were a band, why on Earth would you risk it?

Oh, and if there is some shred of evidence or proof that Randy was actually responsible for this incident, I would like to see it. So far, there has been no evidence released to support the CR's claim. I doubt they have any evidence at all or we would have seen it by now.

No matter how this turns out, the CR is going to be worse off, not better, for it because bands will think twice before playing there. Think insurance costs.

You're aware that there are hundreds and hundreds of foreign bands touring the czech?? Most international tours hit the czech republic sooner or later. All of them were able to leave without a problem. They just didn't have people die at their shows, who have been pushed off the stage shortly before they died. Nothing has changed and no one has to fear anything. Just do not touch the fans. Let local security handle the fans. Give out strict orders what to do, should some one attempt to enter the stage (repeatedly) and you're out of trouble.

Randy Blythe has been very critical about the U.S. for a long time and has said alot of negative things about the U.S. in the past. After going through this I wonder if his opinions have changed.

After following this case, the way things are done in the U.S. don't look so bad.

I'll bet once Randy gets through this and is finally released he'll come back home with a much different opinion of the U.S.

I don't know the ins & outs of it. It seems to me that the justice system in Czech Rep is very biased towards people who promote Rock music simply because they see it as 'Devil worship'???. I feel that Randy is being made an example of here which is totally unfair and unjust.

Ever been to Prague? it's f'n beautiful, maybe the most amazing city I've ever been to. And as a whole the people of CZ are good, genuine folks, not the cavemen that they're being painted as by the intellectual stomping ground known as "the metal community"

Agreed. Of all the big cities in Europe that I've stayed in, Prague is my favorite. Not only are the natives nice, there is quite the interesting bunch of Americans and Europeans who have chosen to settle there. I got to spend a month there in 2002.

Arrogance is a human trait, not specific to Americans. Some Americans are arrogant, but not all Americans are arrogant. Way to scapegoat. And Randy didn't just "do whatever he wanted" like you claim. He simply got on a stage & sang some words, the same way he's done for hundreds of gigs for nearly 15 years.

Let me break this down into ridiculous terms. let's say you're a guest in my house. on my fridge, there is warning that says no one, except me, is allowed to drink from the carton of milk. (In this, the "milk" is the stage) You blatantly ignore the posted rule, (No Stagediving, as most venues have policies against) and drink from the carton not once, but THREE TIMES, which I have video evidence of showing you committing the crime. I, as Head of the Household, decide that your infraction against the law means I can lock you in my basement. A week later, I say If you give me $2000 US dollars, I'll let you out. You pony up the cash, but then my wife comes in a says "F that! He's not going anywhere, he shouldn't have drank from the carton." (Here, my wife is the Prosecutor, disputing the terms of release.) Now, you're stuck in my basement for another week, meanwhile, you're losing a lot of money from missing work and you're job is about to terminate you for being able to make it in. Of course, your friends & fam,ily are like, "What the hell, he paid the $2K, why is he still in dude's basement?" Then, my friends are calling your defenders "arrogant pieces of shit" because, hey, you shouldn't have drank my fuckin milk. Then, my wife comes in and says "Give us another $2k and we'll *think* about letting you go."

The main difference between my milk & Randy pushing the kid, besides the obvious, is the fact that I have INDISPUTABLE EVIDENCE IN THE FORM OF VIDEO RECORDING clearly showing you drank from the carton, whereas the "video evidence" of Randy pushing the kid has nothing on it indicating the the kid died due to the force of Randy's push. This kid could've been wasted drunk after the show, mouthed off to the wrong person, who smashed him in the head, which resulted in his death. Assuming Randy was responsible for the death is about as valid as assuming the kid had an unknown assailant after the show. There is no direct evidence proving one way or the other.

But it's easier for you to blame this on the "Arrogant Americans" because that's exactly what the bullshit media portrays. never see any reports about what we do with financial aid, right? And, instead of metalheads uniting & calling bullshit when it obviously is, it turns into a war of National pride, when metal should surpass boundaries of Nationality.

Music speaks to every race, creed & gender. If you do not understand this, then it is of my opinion that you don't know what heavy music is about in the first place

This has turned into something more than obvious. I am going to wager when they pay another 200 grand that he is not let out again. And if they do, they will let him flee the country, either way the 19th poorest country in Europe (give or take a spot) will have soaked this band dry and gotten away with it.

Stay the fuck out of Eastern Europe, it's for your own good.

It is a shame because as someone said earlier, Prague is a beautiful place.

Unfortunately the beauty of the land does not say much for those in power. It never does, in any Country, including mine.

Just a thought.

If Randy will skip his bail and leave the country Czech police will issue European Arrest Warrant (google it!). Czech republic is member state of European union and if then Randy visits any EU country, he will be arrested.
