GEOFF TATE's Wife Responds To Allegations Of Mismanagement Of QUEENSRŸCHE Affairs - July 16, 2012
QUEENSRŸCHE members Michael Wilton, Eddie Jackson, Scott Rockenfield and Parker Lundgren announced on June 20 that they were parting ways with singer Geoff Tate and recruiting powerhouse vocalist Todd La Torre of CRIMSON GLORY as his replacement. The new QUEENSRŸCHE lineup has already performed live, having played two shows in their home city of Seattle under the name RISING WEST.

Tate revealed in a recent interview with RollingStone.com that he and his wife, Susan, who has been managing the band for the past several years, filed a lawsuit against his former bandmates on June 22 in King County Superior Court in the state of Washington in order to "sort out who is what, and who owns what, and that stuff." Tate is also attempting to get a court injunction against Wilton, Jackson and Rockenfield that would prevent them from using the name QUEENSRŸCHE for their new group.

On July 9, Wilton, Jackson and Rockenfield filed a response to Tate's motion for preliminary injunction and included individual declarations from all of the defendants supporting their position that Tate's motion should be denied.

In her sworn "reply declaration in further support" of Geoff's motion for preliminary injunction — which was filed last Thursday, July 12 in the King County Superior Court in Seattle, Washington and obtained by BLABBERMOUTH.NETSusan Tate says, "The defendants' response paints an inaccurate picture of how I became the manager of QUEENSRŸCHE. The decisions which ultimately led the band to hire me were made by Rockenfield, Jackson, and Wilton. Their allegations that I usurped control of management are untrue.

"I was initially hired by QUEENSRŸCHE to run the band's fan 'club in 1997. At that time, the fan club was in debt and had only 500 members. Within a year, membership increased to 5,000 members and it became a source of profit for the band. I ran the operations for a few years, but left to pursue other opportunities. After I left, the fan club slowly declined in membership and began to lose money. Eddie Jackson asked me if I would consider running the fan club again. I accepted the offer and quickly returned the membership and revenue to the levels it had been prior to my departure. I later became responsible for the merchandising operations, too.

"In 2001, the band was becoming dissatisfied with its manager at the time. It seemed as though the manager was not doing enough to promote and book performances for the band.

"The band desired to get back out on tour and play with some well-known bands. Word spread that IRON MAIDEN, another metal band, was searching for an opening act for an upcoming tour. The band asked its manager to contact IRON MAIDEN's management to see if IRON MAIDEN was interested in having QUEENSRŸCHE be the opening act. The manager said that IRON MAIDEN did not return repeated phone calls.

"Worried that QUEENSRŸCHE would miss the opportunity to get on the tour with IRON MAIDEN, I asked Geoff if he would mind if I contacted IRON MAIDEN to see why it had not returned the phone calls. Geoff agreed that a different tact might yield a more positive result. I called IRON MAIDEN's management and the manager said he had not heard from the band's manager. The manager said that IRON MAIDEN would love to have QUEENSRŸCHE join them on the upcoming tour. I contacted the band members who quickly agreed to join the IRON MAIDEN tour. I then negotiated the contract with IRON MAIDEN. This tour earned the band around $500,000. Geoff then contacted KISS, another major metal band that QUEENSRŸCHE knew was organizing a tour. Despite the band's manager saying he had contacted that contacted KISS, KISS's manager said that no one from QUEENSRŸCHE had called them about becoming an opening act.

"Based on the lack of communication and the mishandling of potential touring opportunities, the band members called a vote and agreed to find a new manager. Lars Sorensen heard that the band needed a new manager. I knew Lars and believed that he would be a good advocate for the band. In May or June of 2001, the band collectively interviewed Lars, liked his ideas, and believed that it was a good idea to have me assist him in thy management of the band. The band paid Lars at least 10% of gross revenue.

"Typically, managers earn 10-20% of gross revenue. I received 3% of gross revenue for my role as assistant manager. Lars was a good advocate, but he began to make expensive mistakes. For example, the budgets he prepared for tours were often so far off that the band ended up losing money. The band's attorney, Neil Sussman, and I took over all tour budgeting and the tours became profitable again. Relations between the band and Lars took a turn for the worse in 2001. Instead of using the band's existing promoter as he had been instructed, Lars booked a tour of Japan using a new promotions company. After the events of 9/11 prevented the band from playing those dates, that promoter filed a lawsuit against the band, which cost QUEENSRŸCHE tens of thousands of dollars.

"As time passed, I began to perform more of the tasks usually performed by a manager. Lars would ask me to do certain activities each week. He would then take my notes and assert to the band that he had actually done the work. Being the assistant, I accepted this arrangement, but did ask Lars to split his commissions with me. Lars agreed to this arrangement.

"In 2005, it was apparent that Sanctuary Records, our current label, was having financial problems. Despite the importance of finding a new label, Lars did not actively search for one. I contacted Kenny Nemes, a friend of mine who was then the vice-president of marketing at Rhino Records, about a record deal. Kenny said that Rhino was interested in signing QUEENSRŸCHE. Due to the lack of involvement by Lars, I alone negotiated the contract with Rhino. Before meeting with the band to review and approve the contract, Lars and I met to discuss it. Despite disappearing at this crucial moment, Lars wanted to take credit for negotiating the deal. I told him that since I had found and negotiated the deal, I would explain it to the band. Instead of facing the band, Lars decided to quit. I panicked and called Scott Rockenfield to tell him the news and to ask him what I should do. Scott, knowing that I had done wonders with the fan club, with the IRON MAIDEN tour, and in obtaining the deal with Rhino, asked if I would consider staying on as the manager if they continued to pay me 5% of gross revenue. Although this was far less than most thanagers made and half of what Lars was paid, I was committed to the band and said that would be fine. Scott then said he would ensure that the rest of the band agreed with his decision. That is how I became the manager of QUEENSRŸCHE.

"Rockenfield, Jackson and Wilton's assertions that Geoff and I conspired to take control of the band by force belies the fact that they were the very ones who hired me as the band's manager.

"During my time as the manager of the band, I worked very hard to maximize the band's earning potential. Given the recessionary climate, this has been difficult over the last five years. Despite this fact, Rockenfield, Jackson, and Wilton earned between $109,000 and $340,000 per year during this time. They never complained to me that they were not earning enough money. Indeed, they seemed pleased with what they were earning at the time.

"I have worked in the music industry for more than 15 years. During this time, the Internet and music-sharing websites, like Napster, have dramatically changed the entire industry. Before the Internet and music-sharing websites, the industry used record sales as a common measure of success. This is no longer the case. Record sales have been steadily declining at nearly 8% per year from 1999 to 2009, with the result that sales of records in 2009 were 57% lower than they were in 1999. Moreover, unauthorized downloads and music-sharing represents about 90% of the market. It is clear that people are still listening to music. But they are not paying for it like they did in the past. Consequently, a band's popularity or business acumen has little to no correlation to the sales of its records. If it did, the same argument could be used to show that nearly every band or performer is about to go bankrupt, which is plainly not the case. Bands and performers now primarily make their living through touring, merchandising, and promotions, not record sales. The lack of sales is correlated with one recent outcome: the declining number of record labels. Each of our last three records labels either closed, is about to close, or filed for bankruptcy.

"The band hired Kevin Scurlock in 1997 to design and be the webmaster for the QUEENSRŸCHE website. Kevin continued in this role up until April or May of 2012. Around this time, Rockenfield, Jackson, and Wilton told him that wanted to save money by switching the website operations to GoDaddy.com. Geoff was uncomfortable with this decision and we spoke to Kevin about how GoDaddy is known as an inexpensive stepping stone for start-up companies. After talking to Kevin, Geoff and I were of the opinion that GoDaddy could not handle a mature, sophisticated website like Queensrcyhe.com. The QUEENSRŸCHE website has an active fan forum, a password-protected fan club, and an online store through which the band solicits merchandising orders. It also has a special system to distribute passes and allow fan club members to purchase tickets. Despite these facts, Rockenfield, Jackson, and Wilton insisted that Kevin facilitate the switch to GoDaddy. Due to this dispute between the band members, Kevin quit. He gave the passcodes for the website to Mr. Susssman.

"Once this dispute arose, Mr. Sussman decided that he could not release any of the passcodes to one group over the other. He held onto the passcodes until he recently released them to all of the band members at the same time.

"At the point I was fired by Rockenfield, Jackson, and Wilton, the band's agent and I had booked five shows for the band to play. After Rockenfield, Jackson, and Wilton publicly fired Geoff, they cancelled these shows. They then attempted to rebook the shows without Geoff, apparently in an attempt to cut Geoff out of any earnings. However, they were only able to rebook one show. This decision probably cost the band and Geoff a substantial sum of money and tarnished the band's reputation.

"The declaration of Paul Geary contains a letter, dated July 2, 2012, from Sullivan D. Bigg of Bigg Time Entertainment. Bigg is an agent, not a promoter. Thus, he books concerts, but does not purchase them on behalf of venues. Bigg suggests that in less than one week, he was able to book the band without Geoff to three shows for a total of $72,000. Tellingly, the contracts for these shows were not provided, which leads me to conclude that these shows were not actually booked. Furthermore, Bigg or Bigg Time Entertainment is not the agent Rockenfield, Jackson, and Wilton hired. In fact, they announced that their new agent is Bobby Lee from Paradise Artists, Inc.

"Despite this announcement, Geary seems to suggest that they are looking at two other agents, John Branigan of William Morris Agency and Ken Fermaglich of The Agency Group, neither of whom is Sullivan Bigg of Bigg Time Entertainment. In the music business, constantly switching agents suggests instability and mismanagement. This conduct illustrates one of the reasons why we decided to pursue the preliminary injunction."

It seems we are all getting trolled by BM here regarding Queensryche. There have been TWO interviews by GT given to Rolling Stone and Billboard, AFTER he was fired by the band (also on Billboard). All other "responds too" posts are them just reprinting all the court docs. None of these have been press released, they are just making it seem this way to drive traffic to the site.

I agree to a certain extent, but for me the telling part of Susan Tate's statement is that she has NOT denied running the expenses AND income of her band (Voodoo whatever they're called) thru Queensryche's books.

Basically, if Wilton/Rockenfield/Jackson can prove she did this, then everything is irrelevant. Because decisions to take a business in this direction or that, declining sales, personality problems, nepotism... yeah they all suck, but it's mainly hearsay.

But if the Wilton/Rockenfield/Jackson claim that Susan ran her band thru Queensryche's accounts is true, then that is flat, outright stealing. Everything else becomes irrelevant.

We'll have to wait and see i guess.

Just take this thing to court. With the actions of Geoff as of late it is really hard to believe anything they say. And all these people stepping up to confirm Geoff did all the work are just saying what they have to so they can work with Geoff again. If Geoff and his wife were controlling the band why wouldn't he tell anyone working on a project that the other guys are not submitting things if he wants to do it all himself? Shady details in everything Geoff & Mrs. Geoff have said. Looking forward to what Queensryche can do with Todd!

This will never make it to court. Geoff already fucked up with his declarations (first claimed he did not hit Rockenfield, then afterwards admitted it) and there are witnesses and video evidence to show what happened in Brazil. Also the shady dealing with the movie rights to Operation: Mindcrime... Geoff is done. He should quit now and go hiding for a while, hoping that people will forget what an utterly despicable person he is.

Well it depends how the fan club is utlized.

Many of them charge a yearly fee or whatever. From that though fans have access to some good shit. Look at like Dave Matthews "warehouse". That is money maker for sure. Shit every concert they get so many request for early sales from the members that they have to do drawings with the members to see who gets access to the early ticket pacakages. Your talking hundreds of packages for every show. I know someone paid $250 a ticket through it and got near the front(pit they call it), a fleece, and vip deck which was nothing special. Same ticket is $75 without that stuff. They easily walked away with making an extra $100 on that fan.

Right about the website, all Geoff news up high, Geoff's name bigger than everyone else's, more solo shows, more wine sales, you'd think it was his personal website instead of the band's website.

Strippers, yeah, you know they always tell you whatever you want to hear. As long as your attention is focused on their chests, you won't pay attention to their hands pulling money out of your wallet. Go back to your old job, Susie baby, and shake those money makers.

No matter what the truth is(though it seems pretty obvious to me that Tate's mostly at fault) the band is incorporated and 75% of the controlling ownership want Tate out - end of argument. A business is a business no matter what the industry and those are the rules any corporation has to follow. No matter how much blood, sweat, and tears Tate has shed for the band and how little anyone else has, he doesn't have a controlling interest in the band and that puts him at the mercy of the other 3 members.

Sorry to hear about all the disputes... If Susan is telling the truth then it seems that she was running the whole show behind the scenes and the band was uncomfortable with that because QR was becoming the Tate family business...
I wish all the best to QR and Geoff Tate because they are one of my favorite bands. I hope they can resolve these business and financial matters which always finds a way to come between bands at some point...

how she says the fan club was soaring in profit when she was there and then it crumbled when she wasn't. Same with her saying that the Iron Maiden tour wasn't working out until she made the phone call and got them on the tour.

Notice how she didn't identify any specific things she supposedly did to increase fan club numbers. Let's see some documentation of what the fanclub numbers were before she took over. She complains that a contract was not shown to her to verify post-Tate bookings, and yet she provides no documentation to prove her own claims. 15 years in the music industry? Let me guess, all working with QR and her husband. And anybody else call bullshit on her claims about Maiden and Kiss?

I would really like to know this too. Fan club membership increases for only a couple of reasons.

1. The popularity of a band increases because of a great album. 2. You offer such a good deal for the price of membership thats its hard to pass up. (t-shirts, memorabillia, drawing to meed the band etc. etc). 3. The band tours places with seats and the fan club members get all the up front seats.

1. We know is false they have been on a dowward spiral in popularity for a long time (everytime I saw them over the last 10 plus years it was either in a smaller venue or less people showed up) 2. I can't say I remember anything super special being offered to joing the fan club that wasn't there before, However I wasn't paying close attention. 3. They have been playing way more smaller places over the last 10 years when they headline so the idea of getting good seats to a gig isnt that great when the place is very small or its all general admsission.

I call bs. I think the only way fan club memberships increased that much is if she was operating the fan club at a loss. Meaning the price to get in was dirt cheap and the stuff the fans got was a steal of a deal. If thats the case then its a bad business move anyways.

I feel bad for G.Tate. What an amazing talent he has. He was highly regarded in the metal community from 1982 to around 2001 as one of the best singer/performer in this genre. He was my hero for a long time. I still respect him as an artist. He tried to take the band to a new level but it never really succeed. He should go take a long break from the industry.

This is a pretty weak sworn statement.. We get a lesson on the music industry, how she helped them get on a tour 10 years ago, and how crappy their old manager was..... I'm sure the other three guys will be allowed to move on with the QR name, but Tate will still get a cut of their money and be able to use the QR name to promote himself

The one part that seems to be a total lie is where Susan talks about how she started out running the fan club.

We're supposed to believe that the Queensryche fan club had 500 members in 1997 when she took it over then within a year she was able to get it up to 5,000 members. She left and the membership dropped a lot, she came back and got the membership back up to 5,000? During those years Queensrych's popularity was dropping big time, who the hell was joing the Queensryche fan club in the late 90's?

Another ting is if their former manager was screwing them out tours with Iron Maiden and Kiss in 2001, why did they keep him until 2005 and they still never fired him, he quit.

I think it's a lie that he wasn't doing his job. He probably quit because his assistant and her husband where going behind his back contacting people and basically cutting him out of his job in order to not pay him and to install a certain wife as manager.

Without a shadow of doubt, Tate's voice and multilayered vocal tracking was a MASSIVE reason for the bands success.
Also, I'm sure I read somewhere that one of Todd Thingy's major musical influences was.....Geoff Tate- nuff said.

Let the rest of 'em continue with their QR tribute band...I'd rather have something new and creative any day...

Why should any of these details decide who gets to use the name Queensryche?

They apparently each own 25% of the name, so if 75% tells the 25% "You're fired, we've replaced you" that should be enough for the 75% to keep the name.

It shouldn't matter who did what or who wrote songs and who didn't. How the manager became the manager or who was responsible for running the fan club 15 years ago.

What's the point of owning 75% of a business if you don't have any power to fire or buy out a 25% owner and then move on?

because as a devoted (?) QR fan who has purchased all of their albums (except Dedicated - no wonder), even the ones that they're not playing or participating (my God I can't believe this shit), I care about what happens and who gets the name...
Now , I hope (and to be honest I'm sure) that Susan is reading these comments...Because I would like to tell you some things...
First of all stop fooling us with the whole decline of sales theory and start connecting a good album with easier access to booking shows. Of course downloading has affected sales but WHEN A BAND RELEASES A GREAT NEW ALBUM IT IS SURE AS HELL THAT IT WILL SELL A LOT MORE THAT THE PREVIOUS ONES AND OF COURSE IT WILL BOOK SHOWS AND SELL MERCHANDISING MUCH MUCH EASIER BECAUSE OF THE BUZZ IT HAS CREATED - EVEN IF A LOT OF THE FANS WILL LISTEN THE ACTUAL ALBUM BY ILLEGALY DOWNLOADING IT! DO THE NAMES ANTHRAX AND ACCEPT RING A BELL????
Where were you when your husband, the self proclaimed leader of this band kept releasing a bad album after the other????
And you're claiming with -pride(??)- that the other members did not participate...We are talking about the musicians that recorded and played in the albums that made you who you are and because of these albums you kept booking QR shows, running the site, selling merch!!! And everyone came to the shows because they wanted to listen to THE WHISPER not OPEN YOUR MIND or IF I WERE A KING, hoping that they will see as much of the old stuff as possible!!!
And ultimately, as you can see from the responses, the vast majority of the fans are siding with Wilton and the others because simply...simply...THEY WANT QUEENSRYCHE TO PLAY METAL AGAIN and by watching the videos of RW ONLY THEY CAN GIVE US HOPE AGAIN!
Where were you when your husband kept losing his voice year after year by not protecting it from his chain smoking...No wonder why he refused to sing songs from the older albums - because he cannot sing them anymore (I've seen them twice recently and either way youtube is here to prove all this - and the spitting of course - my God what a shame...).
I suppose that you are a manager whenever there's money involved, is that right?
Either way your claims are so vague and the fans are so against you that it makes me wonder why are you pursuing this - i hope that you lose the case...
For fuck's sake Geoff I'm so sorry for what you've become (yes Lead Singer DIsease exists as it seems...) and I'm telling you this as a fan of your once mighty abilities and I am a fucking singer...
PS it's funny that they are using the term "metal" in their claims (now we don't hate it, huh?)

For the most part basically all that is left of Queensryche fans are diehard fans. The diehard fans have by and large taken the side of Rockenfield, Jackson and Whilton.

If Geoff gets the name it won't help him much as the diehard fans of Queensryche will not show up to see his shows. The only way he makes money off of it, is if he cons promoters to add Queensryche as a support act at festivals or for other large bands.

Give it up Geoff, if you keep the Queensryche name qQueensryche is dead. If the other 3 get the name they have a change at keeping the Queensryche name and band alive and well.

A lot of conflicting stories but, if she ran Voodoo with the Queensryche money that is completely fucked up and inexcusable from a business perspective as it does nothing to contribute to Queensryche.

Likewise selling the movie rights to Operation: Mindcrime behind everyone's back if equally fucked up.

When albums are not well received, first week sales fall well short of what was projected, ask Metallica. Dedicated To Chaos tanked, but not because we all were hot to download it, no. It tanked because it sucked, simple as that.

The fuck would any of you know what the truth is? Are any of you in the band? The band's management? No. It could be that after 35yrs, they're just sick of each other. They aren't making a lot of $$ (even though they are all worth $15m+) & they're just sick of each other. If she was managing that band for just 5%, they took advantage of her.

Another day of dramatic call and response.

Nobody here knows any more than what they read in the dozens of posts about Queensryche. One side says one thing, the other side denies it. Even reading between the lines doesn't get you anywhere since it's just more of the same. But for giggles, here's what I've taken from it all.

-If the fanclub went from 500 to 5,000 in one year despite interest in the band not growing even slightly, she must've fucked every one of the 4,500 people who signed up for, apparently, no real reason. Either that or Geoff did. Or both.
-Susan might be (probably is) veiling her role as the person who got the band on tours with Maiden and Kiss by saying the manager failed to do this himself so she did it. She could easily be throwing him to the wolves and giving herself a bigger role in the story. Did she go behind the managers back? Fuck, who knows.
-Being the bands manager at the time, she and Geoff could've easily had the passcodes for the websites changed and denied the other bandmembers access to them. This has been done countless times in other bands. Considering how heavy the coverage of Geoff was, it's not an unreasonable conclusion.
-Shutting bandmembers out of recording sessions while someone in the band uses session players instead happens a lot. In this case, let the singer get an idea in their head about how the songs should be and they tend to go overboard with their "vision." Sound familiar, Axl?
-I'm still laughing about the fanclub claims.
-The majority of people siding with the Tate's have either worked with him in the past, or are currently working with them. Or they have something to gain in the future. Sworn states should really be from nobody but bandmembers and managers. Sure, stories from someone who was in the band for an album cycle can shed a little light on a situation, but it's a blip on the career-wise radar, especially if they joined leading up to a breakup.

Get enough people to believe a lie, it'll be considered the truth.
