LAMB OF GOD Frontman Still In Czech Jail - June 30, 2012
According to the Czech news site Blesk.cz, LAMB OF GOD frontman Randy Blythe appeared in court shortly before 10 a.m. today for a hearing in connection with the death of a fan more than two years ago.

Blythe, who was arrested Wednesday (June 27) at the Prague airport on manslaughter charges, will reportedly be released on 4 million Czech Koruna bail (approximately $200,000 — an amount which, according to the site, Randy claimed was the equivalent of his annual income). Since most banks are closed this weekend, Blythe will be allowed to pay off his bail on Monday (July 2). The singer, who did not speak at his hearing and was "timid as a lamb," was considered a flight risk by the judge and will reportedly have to remain in the country at least for the next two days. Photos and video footage (see below) of Blythe in court show him wearing an OBITUARY hooded sweatshirt and American flag hat. For safety reasons, he also had his shoelaces removed while he was in the pre-trial detention cell.

LAMB OF GOD guitarist Mark Morton — who, along with the rest of the band, is in Prague, tweeted a few hours ago, "Today just turned into a FANTASTIC day!!!"

Blythe, 41, who was represented by two lawyers in court, is accused of causing the fatal injury that occurred at LAMB OF GOD's May 24, 2010 show in Prague. The singer apparently either pushed or struck a 19-year-old fan named Daniel N. who had come on stage, and that person died 14 days later of bleeding in the brain.

According to WTVR-TV, another Czech online news site, Aktualne.cz, has published statements from a witness — a friend of the victim — who said the fan wasn't using drugs or alcohol and fell back directly on his head. The victim lapsed into a coma and died two weeks later.

The crime of which Blythe is being accused is punishable by up to ten years in prison, according to popular Czech news web site Novinky.cz.

LAMB OF GOD was scheduled to perform on Thursday at the Rock Café in Prague with SKELETONWITCH and ALL SHALL PERISH but that show ended up getting canceled.

LAMB OF GOD's publicist, Adrenaline PR, issued a statement yesterday stressing that "under no circumstances was there a fight of any kind involved [during LAMB OF GOD's 2010 concert]. This incident deals with a fan that three times during the concert jumped the barricade and rushed Randy during the performance. It is alleged that the third time, security was not able to reach him and that Randy pushed him back into the audience where supposedly he fell and hit his head."

Now just never go back to the Czech Republic and this should be all over. You see how things really work -- give us $200,000 and this ends, or we keep holding you in our jail.

The problem here is the foreign country. In his home country, there are common sense laws and legal concepts like assumption of risk that would have meant no charges were ever filed. If you jump on a stage at a concert, you have trespassed and cannot sue anyone if you receive the appropriate beat down, much less have criminal charges filed. But in other countries, there's nothing they like better than shaking down "rich" travelers who make a mistake.

Not to be a dick, but by that mildly retarded logic, Security's failure to interfere somehow then magically gives you the license to kill. Not saying that's what happened, but that's kind of the point, we don't fucking know what happened.

Actually, you are being a dick. His logic didn't imply a "License to kill". From what it's being reported Randy was using resonable force (a push) to defend himself. That other guy was the one with the reckless attitude putting himself and Randy in a degearous situation.

Right, metalisdumb. One time jumping on stage, you let it pass and allow security to handle it. After that, when the same guy rushes you again, you defend yourself. Since security failed to do their job the third time, he had to defend himself. I guess they don't understand the concept of self defense in Czechland.

Of note is the fact that this happened two years ago. They waited until Lamb of God returned to their country to arrest him, obviously salivating over the chance to steal some money from the wealthy entertainer. So this is just the usual shakedown at the border routine that bands travelling around the world have to face.

Give me a break, these guys do VERY well for themselves, and while not all bands are as big as LOG, you can bet that a lot of band members are pulling in at least $50,000 per year, which is not bad at all for not having a real job.

What the fuck does any band owe you that you can just take something that cost them a lot of time & money to produce? They spend months writing the music, they have to pay for the costs of recording, producing & promoting their work & they don't owe you or anyone else a fucking thing. Yeah a record company will front you the cash but don't expect to make a cent for yourself until ALL production & promotional costs are repaid IN FULL. You're a fucking tool! $50,000 a year to be away from your family and friends for nine months at a time is not a shitload of money. On top of that, bands aren't the only people that have been hurt by your theft of their music. The record companies, management companies, publishing companies, etc. have laid off thousands of employees because the revenue just isn't there anymore, thanks to dickheads like you who think that it's ok to be a thief, as long as you know you'll get away with it. Half the people trolling about how Randy should stay in jail have the luxury of making such statements from the safety of their own countries. "Timid as a lamb?" So what? I was in jail in near Munich Germany in the Bavarian region of southern Germany. It is relatively close to the Czech Republic. My band was on tour and we got pulled over and I had weed on me. Usually not a problem in most parts of western Europe. But in conservative Bavaria you go to jail for it.

The jail was MUCH NICER than south Florida or Georgia jails. They shook me down for all the cash I had on me. About 330 marks which at the time equaled about $220 dollars. It was NOT scary, in fact I mouthed off to the "detective" at the station questioning me. They just wanted to collect some funds!

is not the norm. i know for a fact that the VAST majority of the metal bands out there are either touring, or are working some crap tastic blue collar day job........most of the time swinging a hammer or the like.

thats why they are on tour all the time now a days. instead of releasing an album every year. now its "make an album tour for it for 2-3 years, release the next album 4 years after the last one".

if people actually bought the albums, we get more faster. people that illegally download music DESERVE rebecca black.

on a side-note, I don't like LoG. Never has, never will. Pantera wannabe posers. I own my own home, have a car, am married, and have 3 kids. I also make over $100,000 per year and work 10 times as hard at my job than most musicians could ever imagine. I also used to play in a band and if I made $50,000 living that life, I'd be pretty satisfied because it is not nearly as much work as what I do now.

Medical expenses? Don't have any because thankfully I live in Canada. Downloading illegal? Not in Canada. Sorry, it is perfectly legal here and I have no problem doing it. I love American's who think that just because things are one way in their country and can't see beyond the tip of their nose, they assume they should be same everywhere else. But I guess that speaks to the history of America being an imperialist, war-mongering state. Bottom line is if I like something enough I'll buy a T-Shirt or see the band live, otherwise, fuck 'em. I prefer bands that make music for the love of making music and the artistic expression involved, not those simply looking to make a buck. Metal was never meant to be about getting rich, and the fact that there is very little money left for bands in the music business today is a good thing as far as I'm concerned, because we'll have true artists doing this rather than a countless number of assholes who just want to be rock stars doing it instead.

Now shut the fuck up Weasel boy, you troglodyte imbecile, I have some music I need to go and download for free.

To be honest, I hope this gets thrown out of court when it goes to trial, if anyone is to blame its the venue and security for letting the guy get up there so many times in the first place. Stagediving may be cool for some, but to continually get up in the singer's face a few times and not expect to at least get a knock is being retarded.

Very unfortunate the kid died, but if theres any justice Randy will be cleared. As a lot of people have said, if they were aware of this then LOG would never have gone back to the country.

If it was that much of a big deal then surely extradition charges would've been brought when the kid died two years ago? Its not like Randy would have been hard to find?!

This shit stinks of someone wanting money, not justice.......

First off, the guy's out on BAIL. He's not off the hook. This wasn't a "shakedown". He still has to have a court case to determine his innocence/guilt. You get that money back. Secondly, I'm guessing the record label has some sort of insurance for these kinds of incidents so I don't think he'd pay bail out of his pocket (though I could be wrong about this).

hey i live in the U.S., i love the U.S., but my head isnt buried in the ground. if you dont think for a second that there wouldnt be some kind of sue-happy legal bullshit going on had this happened in the U.S., i got a bridge to sell ya.

arrested? maybe not. sued into oblivion? you bet yer ass......theyd at least try. and as for "those foreign jails are scary places"......man, i wouldnt want to spend a second in any american jail. all run by mexican gangs, black gangs, and the white power freaks.

I didn't know the kid died until just now. Hell of a way to wake up.

And of course it's sad that he died, but that wouldn't have happened if he wasn't being a dumb dick. I'm not saying he deserved it, but Blythe certainly had the right to push him the fuck off the stage.

Obviously, the guy got trampled, which isn't Blythe's fault. It was the fans. Happened at a GNR outdoor gig in the 90's.

Blythe will get cleared.

.....you think youve been in a band, and you think you work harder. if youve never actually been on tour you have zero idea what yer talking about.

im talking about a tour like what kiss or metallica do now a days, im talking about being on the road for 6 months or more with 10 people in a van designed to hold 5. tryin goin 6 months straight with less than 4 hours sleep, slugging around yer own gear, eating bread for breakfast, lunch and dinner, not having a shower for weeks on end. no privacy ect.

theres a good reason bands get signed, and 2 years later at least one of the band members is replaced: more than not, they couldnt handle the stresses of touring. on of the first jobs i ever had growing up was a roofing job, and it was CAKE compared to a piddly 3 week tour i was on.

you know 2 things about what metal bands go through now a days:

1. jack
2. shit

and jack left town.

as far as the america bashing goes, thats cool bro, id rather live in the evil empire than your dogshit frozen tundra where they take 6 months to look at broken arms. if it werent for rush, your entire country would been an afterthought in the world of rock n' roll......and even they (rush) dont make up for brian adams.

Let me express my opinion on this issue. I´m from Czech Republic, therefore I think I can provide the different point of view on the entire situation.
The main argument to prove the vocalist is innoncent I read in many coments all over the internet is, that after Pantera guitarist was shot dead, the bands are scared of the fans jumping on stage and the musicians have right to protect themself.
In my opinion, this is sompletelly twisted. The so called "megastars" should get back on the ground as fast as possible and get focused on the things which are really important. Let me write down some thoughts that may help to understand what the cultural difference is and how people in different parts of the world handkle their stuf. And surprisingly, it is not so much about the different cultural views, it is mainly in the peoples mind and what they think and do, no matter what country they live in.
1) the incident with shooting Dimebag Darell dead happened in the USA, the country which is very specific in the guns acceptance within the population (due to the famous Second Amendment to the Constitution) and studying the articles and news all around the web, the murderer was mentally sick paranoic schizophrenic. Also this incident was very isolated and rare. I have no idea how difficult/easy it is to get the gun in the USA, but in most EU countries, Czech Rep. included, you cannot just jump into the gun store, get yourself 9mm and go home. Every person wanting arm him/herself must go through the psychgological test as well as shooting traing, medical examination proving that person is able to handle the gun and many other things, not to mention the financial costs you need to pay on for all those papers and stamps.
To simplyfy what I´m trying to explain a little - we do not see guns being held by people on public. Also very little number of gun incidents are commited in Czech Republic (considering the crimes/population ratio). I am 34 now and I have never seen the gun incident on my own eyes. Actually I have never seen a gun being off the pocket in my life (on public). My cousin have one, he is the gun-licence holder, but he just showed it to me at home and that´s it. Of course - we have criminals here, robberies, drug dealers, hookers and pimps business, russian and albanian mafia fights and many other sick shit all around the country, all this of course with many illegal guns included, but basically this shit happens within those drug/hookers bastards and normal people simply do not arm themselves so much. And considering this, no one would attend the metal gig thinking that band members are afraid of being shot. This is something completelly out of peoples mind. So I can imagine that if the kid jumps on stage, just wantig to show he is complete asshole and then jumps down, well, that´s nothing to be considered as threat or danger of any kind.
Also I need to mention here, that I´m far away from being some kind of pacifist or so. I can say I kind of like guns, I was in the army for one year (it was mandatory for all young men of 18 years of age an older, mandatory army service was cancelled maybe only ten years ago). But all this would never lead me to the idea that I should arm myself and bring the gun the the metal gig for some reason.

2) the stage-diving is just part of this, take it or leave it. Couple of months ago, I attended Napalm Death gig in Ostrava, third biggest city in the county. The club was quite big, definitelly bigger than Abaton club at Prague, where LOG gig was placed in 2010. The security pre-cautions were ok, just check for any metal objects you may possess in your pockets and then you could get in. The crowd was approximatelly 400 - 600 heads. Napal Death played perfect set and there were fans climbing onto the stage and jumping down almost all the time. Personally - I do not like it, because I like to see the band playing and listen with no drunken asshole ruining my view. The only thing I do at gis is a little bit of headbang, some jumping up and down and that´s it. But if someone likes to dive down the stage, well, why not - enjoy.
Napalm Death did not said even a word because of the stage-divers. When some stupid idiot stood on the stage for too long waving his hands to the crowd and so on, security guy just tapped his shoulder to remind him he is not the star of the evening, and when he did not jumped on his own, security guy helped him down a litte, but never with unnecessary aggression or inpropriate attack intensity.
And than one moment came, this was maybe most hillarious thing of entire show - Barney Greenway showed how OK he was and while one drunken half-naked asshole jumped onto stage again, turned to the crowd waving arms and dancing, Barney came to him, grabbed one of the man´s tits from behind while still singing, twisted the tit for a brief moment and than laughed and went on with the blasting show. The fan maybe even didn´t noticed what happened. And that was actually the most funny thing on all this.
Can you feel the difference here? Napal Death - on top for decades by now and absolutelly no mark of an arrogant or condoning behaviour. They know where their place is, they know why they are still here after all those years: just because of the fans.
On the other hand - Lamb Of God, when they released their debut, Napal Death had already 7 albus out. Lamb Of God might be comercially more succesful nowadays, but it seems, that they have lost the track of what the main pupropse of being in the band is and what playing for their fans means. And - instead of twisting one fan´s tits on the stage and having fun, rathrer kicking the other one down from stage so he dies two weeks later. Sure - LOG are in the business for quite a long time by now as well, but than it is even more surprising they can not feel the diference between real danger and discomfort or just complication.

3) I cannot hold back the idea of reminding how visionary and true Ian Mackaye from Fugazi was many years ago. Fugazi simply did not accept any kind of fighs, circle pit mosh or dangerous stage-diving on their shows. I may not cite his words exactly, but once he said something like: "Attending the hardcore/punk show does not mean, you need to behave like an idiot."
If fight, moshing or stagedivng appeared on later Fugazi show, they stopped playing, the people involved in this were taken out of the venue and their ticket money were re-fund to them.
Also, according to the information you can find on the web, he formed the corporation to defend himself and bandmates, citing wikipedia:
"In the summer of 1990 formed the corporation Lunar Atrocities Ltd in order to shield his own and his band mates personal assets from the threat of lawsuits. As Seth Martin, MacKaye's financial advisor explained to the Washington Post in a 1993 interview: "protection from liability is the main reason to form a corporation, and for these guys it makes sense. If someone got hurt stage-diving and decided to sue, it would be a little harder to go after their personal assets."
So actually not only trying to be reasonable and calm down the wild kids on the shows, but also protecting his own band in case some stupid asshole breaks his neck stagediving and decides the band is to blame.
But this is obviously not the case in LOG issue and even if LOG had some kind of similar company, they would not be able to help them very much since the singer is directly involved in the incident. The kid did not get his injury on his own.
If the band - LOG - do not like people on the stage so much, they had to put it into the contract and specifically ask for more security guys to be placed between stage and crowd. And if this is not fulfiled by promoter and venue stuff, than simply not play the gig. Yeah, this would be bad for band´s media picture and fans will be upset that night, but with clear statement that security pre-cautions were not fulfiled and the money would be re-fund to the people (promoter should be responsible for this), there should be no problem and fans would accept this.
4) being musician myself, I also do not like some drunken idiots stepping on my cables and pedals or falling down on my feet while trying to play, but there are so many things you can do instead of attacking: step backwars couple of meters, stop playing for a second and avoid the person completelly, simply whatever is possible. To be aggressive to the person should be the last option and should be avoided if possible.

Well, how to sumarize it?
Every time something like this happens, it is bad for the scene, bad for the bands and bad for fans. No discussion about this.
I do believe the singer did not intend to harm the kid. It seems to me, that he was just so self-confident and sure nothing can happen, that he did not even thing about possible consequences. Manslaughter is maybe a wrong definition of what he did. The crime he is being accused of is called "harming the health resulting in death".
Thinking about this from many angles, trying to stand on singer´s side - I cannot do so.
He simply should not have behaved like this. No one will bring the dead kid back to life now and his family will never forget what hapened.
Peopple should be responsible for their acts. Being famous metal singer should not give the person the feeling, that he can do everything he things is ok and nothing serious can happen.
The dead kid was the fan of the band, from the info I could find on the web it seems he was the true metal head and guitar player in the local band as well, far away from dangerous gun-shoting murderer. Sure - he should not have climbed onto the stage. But no one should die just because of doing so, which is basically what happened.

The singer is out from prison, but not freed yet. There will be the court to judge if he is or is not guilty of causing the death of the kid.
Let the court decide.

Why was this fan on stage by the band in the first place? What did the fan do to breach security? How much of a threat could he have been to the band members?

Is Randy really responsible for the young man's death? If in fact, the young man was pushed from the stage by Randy, can it be proven that this is what caused the fatal injury? What about the raucous audience? Could he have been trampled on his head? Could a concert-goer have gotten angry with the young man and dropped him on his head intentionally instead of keeping him afloat in the crowd? Could a concert-goer have intentionally hurt the man resulting in the deadly injury?

I could go on and on. The fact remains that there must be sufficient proof that randy is responsible for causing an injury that resulted in the man's death.

This could be interesting if it goes to trial, but I find it hard to believe that the prosecution can prove that Randy's action was the sole cause of this young man's death. There are so many variables in that environment.

being pushed or shoved is still assault. Just because it's trespassing on the stage, it does not qualify for a "make my day" approach to "protecting" yourself.

That being said, after being pushed/shoved from the stage, the fan "allegedly" hits his head as a direct result. Because the articles I've read (just a couple, mind you) use the term allegedly, it seems as though they do not have enough hard evidence to directly say, "Yeah, your actions caused this death."

Because of the unknown variables, it seems like eye-witness testimony would cast reasonable doubt. Damning evidence could be video footage of the show, shot either professionally or by an amateur. We'll have to wait and see.

Any Czech fans on here that can speak to how the Czech laws deal with something like this?
